Florida is a "Transaction Brokerage" state. Transaction Brokers can NOT provide a Buyer Fiduciary Representation.   In 2008 Florida dropped the requirement that agents  MUST identify to prospective Buyers and Sellers .. who they represent at their initial meeting. This was to be prior to showing any homes for sale.

Florida's EBA's commitment to Buyers is unique in today's Seller orientated Real Estate Industry. Florida home buyers have traditionally been represented by agents that work for Listing Brokerages or the Sellers Agent.  The vast majority of Florida brokerages contract with the Seller. Agents working for Listing Brokerages have an obligation to sell the Brokerages Listings.

This raises a Conflict of Interest issue, because some States have banned the practice of "Dual Agency". The Oklahoma Supreme Court has ruled that Buyers "do not and can not" receive the same representation as the Seller.
